These Terms of Service ("Terms") govern your access to and use of www.bluedoorliving.org and any related services, portals, and applications operated by Blue Door Living, LLC ("Blue Door Living," "we," "us," or "our"). By accessing or using our Site or services, you agree to these Terms. If you do not agree, please do not use our Site or services.

1. Who We Are and What We Do

Blue Door Living, LLC is a property management company located in Manchester, New Hampshire. We market rental properties on behalf of owners, screen prospective tenants, prepare and execute leases, collect rent, manage maintenance, and provide related services. Our Site provides information about our services, listings of available properties, and access to online portals for property owners and residents.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use our Site or services. By using our Site, you represent that you meet these requirements.

3. User Accounts and Portals

Some features of our services, including the Owner Portal and Resident Portal, require an account. You are responsible for:

• Providing accurate, current, and complete information.

• Maintaining the confidentiality of your login credentials.

• All activity that occurs under your account.

• Notifying us immediately of any unauthorized use of your account.

We may suspend or terminate accounts at our discretion, including for violations of these Terms or applicable law.

4. Property Listings and Applications

We make reasonable efforts to keep property listings, photos, rent amounts, and availability accurate, but we do not warrant that all information is complete or error-free. Listings may change without notice, and properties may be rented or withdrawn before applications are processed.

Submitting a rental application authorizes us, and our screening partners (including AppFolio screening), to verify the information you provide and to obtain consumer reports, including credit, criminal, and rental history reports, as permitted by applicable law. Application fees are non-refundable except where required by law.

5. Fair Housing

Blue Door Living complies with the federal Fair Housing Act, New Hampshire fair housing laws, and all applicable state and local non-discrimination requirements. We do not discriminate on the basis of race, color, national origin, religion, sex, familial status, disability, or any other protected characteristic.

6. Rent Payments and Financial Transactions

Online rent payments, owner distributions, and other financial transactions are processed through AppFolio. Your use of these financial services is subject to AppFolio's terms and to any additional terms in your lease, management agreement, or owner contract. Blue Door Living is not responsible for delays, errors, or fees arising from third-party payment processors, banks, or financial institutions.

7. Relationship to Leases and Management Agreements

These Terms govern only your use of our Site and services. Your underlying rental, lease, or property management relationship is governed by the separate written agreement (lease, management agreement, or similar contract) between you and Blue Door Living or the property owner. In the event of any conflict between these Terms and your written agreement, the written agreement controls for matters within its scope.

8. Acceptable Use

When using our Site, you agree NOT to:

• Violate any applicable law or regulation.

• Submit false, misleading, or fraudulent information.

• Interfere with or disrupt the Site or its security features.

• Attempt to gain unauthorized access to any portion of the Site or to other users' accounts.

• Use the Site to harass, threaten, defame, or harm any person.

• Scrape, copy, or use Site content for commercial purposes without our written permission.

• Upload viruses, malware, or other harmful code.

9. Intellectual Property

The Site and its content — including text, graphics, logos, photos, and software — are the property of Blue Door Living or our licensors and are protected by U.S. and international intellectual property laws. You may use the Site for personal, non-commercial purposes only. All other uses require our prior written consent.

10. Third-Party Services and Links

Our Site uses and links to third-party services, including AppFolio, Wix (our website host), Google Analytics, and Google Ads. We are not responsible for the content, policies, or practices of third parties. Your use of those services is subject to their own terms and privacy policies.

11. Disclaimer of Warranties

The Site and our services are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that the Site will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the fullest extent permitted by law, Blue Door Living and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Site will not exceed one hundred dollars ($100) or the amount you paid us, if any, in the 12 months preceding the claim — whichever is greater.

This section does not limit any liability that cannot be excluded under applicable law, including liability under the terms of your lease or management agreement.

13. Indemnification

You agree to indemnify and hold harmless Blue Door Living and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of any rights of another person or entity.

14. Termination

We may suspend or terminate your access to the Site or any account at our discretion, with or without notice, for any reason, including violation of these Terms. You may stop using the Site at any time. Sections that by their nature should survive termination (including sections 9, 11, 12, 13, 15, and 16) will survive.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site will be resolved exclusively in the state or federal courts located in Hillsborough County, New Hampshire, and you consent to the personal jurisdiction of those courts.

This section does not apply to disputes arising under your lease or property management agreement, which are governed by the dispute provisions in those agreements.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and, when appropriate, provide additional notice. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
